Jake Berry MP backs Chancellor’s call to change unfair dismissal qualification period to 2 years
Jake is in favour of reform of the employment tribunal system which is currently a major cost to business.

There were 236,000 employment tribunal claims last year, with an average award for successful claimants of £8,900, and an average cost of defending a claim at £4,000. That is despite the fact that many applications don’t result in a full hearing or are settled out of court, while still burdening businesses with these substantial legal costs.
Business groups, including the CBI, have long been calling for reform of the employment tribunal system. Currently employees can usually claim unfair dismissal only if they have worked for an employer for at least one year. The Government is going to increase the qualification period to two years from April 2012. This will benefit businesses by around £6 million per year in reduced legal fees and payouts. However, employees will of course retain ‘day one’ rights such as the right not to be discriminated against.
Jake Berry said:
‘It is always crucial businesses have the confidence they need to create jobs and particularly so at a time when there is great economic uncertainty. It is essential that we support businesses taking on new staff, and help create more opportunities for those looking for work.
By reducing the risk of tribunals and all the costs and disruption they bring, it will give businesses more confidence to hire people.’
